Global Privacy Policy For End Users of United Recycler Group Auto Parts Marketing and Sale Software (this “Privacy Policy”)
United Recyclers Group, LLC (“URG”) respects each End User’s right to privacy. This Privacy Policy describes, among other things, URG’s handling of each End User’s (and Registered User’s) personal information. Initially capitalized terms not otherwise defined in this Privacy Policy have the meanings given them in the End User License Agreement and Terms of Use for URG’s Auto Parts Marketing and Sale Software (the “EULA”). This Privacy Policy applies to personal information collected by URG at the time a User registers to access the URG Platform and to use the Cloud Services and that URG collects from:
- (a) User’s use of the Cloud Services and associated websites, mobile applications, and social media pages (“On-line Channels”); and
- (b) URG’s distributors, suppliers, and vendors (collectively, “Business Collaborators”).
On-line Channels (e.g., via third-party links) and Business Collaborators (e.g., via contractual arrangements) may gain or have access to your personal information that URG does not control and is therefore not responsible for the manner of handling or using that information. If User does not want URG to handle User’s personal information or does not consent to this Privacy Policy, User should not use the Cloud Services, access the URG Platform, or otherwise interact with URG.
General Principles
User information belongs to the User but is needed to provide the Cloud Services and permit access to the URG Platform, which means that URG must use or share User information as described in the EULA and this Privacy Policy. URG has taken steps to protect User information from third parties, except as legally required. To the extent required by applicable law, whenever URG collects a User’s personal information, URG will:
- (a) Advise User about URG’s personal information data practices, which is being satisfied by the publication of this Privacy Policy for User’s review;
- (b) Collect User’s personal information only for legitimate and specified purposes;
- (c) Process User’s personal information in a manner consistent with the purposes for which URG collected it, which is providing access to the URG Platform and use of the Cloud Services;
- (d) Not use User’s personal information for direct marketing purposes without giving User an opportunity to “opt-out”; and
- (e) Take appropriate measures to protect User’s personal information that URG discloses to third parties apart from providing the Cloud Services.
Collecting Personal Information
Information Provided with Registration: URG will collect from Users the following information which will form part of each User’s User Account:
- Name (typically the name of the company unless the User is an individual)
- Phone Number
- Email Address
- Website Address
- Tax Identification Number
- Postal Address for Billing (Street Address, City, State, Zip Code and Country)
- Shipping Address for Billing (Street Address, City, State, Zip Code and Country)
- Approved Payment Methods
- Preferred Stores
- Name of Primary Contact (First and Last name)
- Primary Contact Email Address
- Primary Contact Phone Number
- Registered Users for each End User (First and last name)
- Email Address for Each Registered User
Information Gathered through User’s Use of the Cloud Services: Through User’s use of the Cloud Services, URG will also collect the User’s comments, orders, questions, requests, Parts orders, payments and payment status, User preferences (such as preferred methods of communication), and User interest in conventions and meetings sponsored by URG. URG may collect statistical information about Users’ use of On-line Channels, including interaction with digital advertisements and promotions, content downloaded or viewed by Users, Web pages visited by Users and path of those visits, links clicked by User, features of the Cloud Services you used, promotion emails opened by Users, and the dates, lengths, and times of your interaction with the URG Platform or use of the Cloud Services. URG will collect this information automatically from User devices through cookies or other similar technologies and may aggregate and anonymize it (such that no User’s personal information can be associated with that User) and use it for any purpose, including product-development or research.
Information Provided through Credit Card Payments for Purchased Parts: Purchasers must pay for Parts purchased using payment application services or through a Charge Account established by a Purchaser with a Seller.
Payment Services. URG will receive information regarding Purchasers and Seller in connection with payments for Parts. Payments may be handled through third-party payment Business Collaborators, such as Stripe, which handles the transactions and User information in accordance with their privacy policies and terms of service, with which Users must comply. URG is not responsible for payment services and Business Collaborators or their terms of service or privacy policies. Users use payment services (“Payment Business Collaborators”) at their own risk and URG hereby disclaims all warranties regarding use of those services. If User uses Payment Business Collaborators, User consents to the Payment Business Collaborator and URG exchanging User information. If URG provides User with access to or enable applications or website links to a Payment Business Collaborator, URG does so only as a convenience and a User’s use of those applications and links is solely between User and the Payment Business Collaborator. Users acknowledge that URG has no control of Payment Business Collaborators and is not responsible or liable to User or the Payment Business Collaborator for losses arising from User’s use of those services and is not responsible for their privacy policies or their implementation of them. URG does not guarantee the availability of those services and may disable use of those services at any time, without liability to any User or to the Payment Business Collaborator.
Charge Accounts. Purchasers may also set up charge accounts (“Seller Charge Accounts”) directly with Sellers who will issue invoices directly to Purchaser for Parts they purchase. The business and contractual relationship under Seller Charge Accounts, and the handling of invoices, payments, credits, and payment disputes, is exclusively between the pertinent Purchaser and Seller. URG is not responsible for payments, or the processing or handling of payments, under Seller Charge Accounts or their terms of service or privacy policies or compliance therewith. Users use Seller Charge Accounts at their own risk and URG hereby disclaims all warranties regarding use thereof. If User uses Seller Charge Accounts, User consents to the Seller exchanging User information with URG under the Seller Charge Accounts. If URG provides User with access to or enable applications or website links to establish a Seller Charge Account, URG does so only as a convenience and a User’s use of those applications and links is solely between User and the pertinent Seller. Users acknowledge that URG has no control of Seller Charge Accounts and is not responsible or liable to User or the Seller for neither losses arising from User’s establishment or use of Seller Charge Account; nor their privacy policies or implementation thereof by Seller or Purchaser. URG does not guarantee the availability of Seller Charge Account, which may be disabled by the Seller providing the Seller Charge Account at any time, without liability to any User.
Information Gathered from User’s Devices: URG will collect technical information about User devices, such as User IP address, device type, operating system, browser settings and type, internet service provider, other device identifiers, and your real-time location. URG collects this information automatically from Users’ devices through cookies or other similar technologies. Please see the discussion below about Cookies.
Using Your Personal Information
To Provide Cloud Services: URG will use User personal information to provide the Cloud Services, which includes: (a) processing Parts requests, locations, pricing, purchases and sale; and (b) performing accounting, auditing, billing, collection, and reconciliation services; and (c) providing User support. URG does not monitor or provide updates on the status of orders to purchase or sell parts; that information is provided directly between the Purchaser and Seller.
To Communicate with Users: URG will use User personal information to communicate with Users outside of the Cloud Services. This may include informing Users of newsletters, promotional activities, products, and services that may be of interest, responding to Users questions, and inviting you to participate in customer satisfaction or market research surveys.
To Provide and Interact with On-line Channels: URG will use User personal information to interact with and communicate through the On-line Channels and to customize them to the User’s preferences and interests and to render them more compatible with Users’ devices, and to maintain and improve security of On-line Channels.
To Address Legal Issues: URG will use User personal information to: (a) satisfy URG’s obligations to generate and maintain business records; (b) ascertain, assert, or defend legal claims; (c) conduct investigations required under law and comply with court orders; (d) detect, prevent, or respond to fraudulent activities, intellectual property infringement, violation of URG’s agreements, violations of law, or other misuse of our On-line Channels; and (e) protect or assert URG’s rights or property, User rights or property, or others’ rights or property.
Disclosing Personal Information
URG will not intentionally disclose User personal information, except to share it with: (a) other Users using the Cloud Services; (b) third parties that provide URG support services (who will likewise be required to treat it consistent with this Privacy Policy and applicable data protection and privacy laws) or work with URG to effect the marketing, locating, purchase, and sale of Parts; (c) third parties when required for a business transaction involving the control or ownership or restructuring of URG, its assets, or its membership interests; or (d) those third parties URG is required to disclose it as required by law. Also, URG may share User personal information with the User’s permission.
Securing Your Personal Information
URG stores your personal information in databases or databases maintained by its Business Collaborators all of which are located in the United States. URG has ensured that its Business Collaborators provide adequate protection for Users’ personal information provided all data remains in Canada or the United States. URG uses reasonable efforts to protect the User personal information in accordance with this Privacy Policy. While URG uses reasonable security measures to protect User personal information against unauthorized alteration, disclosure, loss, or misuse, it cannot guarantee the security of User personal information, and is not responsible for breaches of security beyond its reasonable control.
Retaining Personal Information
Generally, URG only maintains personal information for as long as necessary to fulfill the purposes for which it was collected. To determine the retention period, URG also considers legal requirements that mandate retention of personal information for specific periods, including resolution of disputes and enforcement of policies.
Using Cookies
“Cookies” are small text files of information that are sent and placed on User devices when accessing the URG Platform and using the Cloud Services. The programming around these text files may require User devices to send cookies to URG to allow it to later recognize the particular device. Users will elect whether to allow URG’s to use cookies. Cookies personalize and enhance the User experience by saving preferences, customizing on-line experiences, and providing advertising that may be tailored to User interests.
URG uses Cookies in managing the URG Platform and the Cloud Services. In most cases, URG does not require that Users accept Cookies to access the URG Platform or use the Cloud Services. URG will seek User consent to use Cookies when accessing the Cloud Services. Cookies may also be deleted. However, certain Cookies are strictly necessary for URG to provide certain aspects of the Cloud Services and, therefore, cannot be blocked from use. If a User chooses not to enable cookies on its device, certain features of On-line Channels may not be available in the same fashion as if cookies were enabled.
Among the cookies URG uses are:
- “Essential Cookies” to recognize a User device when accessing the URG Platform and using the Cloud Services.
- “Session Cookies,” which do not identify the User and expire after the pertinent web browser session, to ensure the proper functionality and operation of the Cloud Services.
- “Persistent Cookies,” which do not expire after a User closes the web browser, but stay on the User’s device until deleted or expired, give User devices unique identifiers, allowing URG to create a database of previous User choices and preferences, which are then used to make future visits more efficient.
- “Advertising Cookies,” which advertisers may use to make advertising messages more relevant to you, both during and after a current on-line session.
Performing Analytics
URG uses third-party web analytic services to better understand User interaction with On-line Channels. The services make it possible for URG to assign data, interactions, and sessions across multiple User devices to a pseudonymous user ID, which allows URG to analyze your activities across your devices.
Linking to Third-Party Internet Sites and Plug-ins
On-line Channels may contain links to external mobile applications, social media platforms, or other websites that URG does not control, as well as plug-ins from other Business Collaborator’s services, such as Facebook’s “Like” feature. While URG provides these links and plug-ins as a courtesy or service to Users, URG does not endorse the activities or content of these Business Collaborators, nor any association, direct or indirect, with their operators, and URG is not responsible for the content of these websites or their privacy practices.
Keeping Children Safe
URG abides by the Children’s On-line Privacy Protection Act. The Cloud Services are specialized services for those purchasing and dealing in automotive parts. URG’s Cloud Services do not knowingly direct or target children under 18 years old nor does URG knowingly collect or solicit personal information from, or about, children under 18 (or the relevant minimum age under applicable local legal requirements). If URG becomes aware of having collected or processed personal information of a child under 13 years of age, URG will promptly delete that information.
Complying with State Laws
Many states have implemented their own laws regarding privacy of personal information. Under these laws, Users may have rights in addition to those set forth herein, such as rights to request certain information regarding URG’s disclosure of personal information to third parties for direct marketing purposes. Our Legal Bases for Processing Your Personal Information
URG’s legal basis for collecting and processing User personal information as described above includes one or more of the following:
- (a) User’s informed consent (including consent to Cookies) through registration and access to the URG Platform and use of the Cloud Services;
- (b) optimization of the contents of On-line Channels for User interactions therewith;
- (c) collection of statistical data;
- (d) provision of customer support or advertising;
- (e) prevention of cyber-attacks and fraud and protection of the URG Platform, the Cloud Services, URG’s premises, and URG’s other systems and On-line Channels;
- (f) cooperation with government authorities;
- (g) advancement or protection of legitimate and usual business interests; and
- (h) compliance with legal obligations.
User Rights
Users may change their personal information or withdraw any consent to use personal information by contacting URG’s Chief Privacy Officer at the e-mail address dataprivacy@autopartsearch.com. Under some circumstances, Users may lodge a complaint with a supervisory authority if User believes URG’s use of User personal information violates data protection rights. Changing this Privacy Policy
URG may change and update this Privacy Policy at any time and without prior notice to any User, which changes will be effective upon publication of the revised Privacy Policy on this web-site.
